Public Works Act

The Public Works Act provides that adjudication provisions in the Prompt Payment and Construction Lien Act apply to adjudications involving public works. In the event of non-payment, the dispute can be referred to adjudication, provided that a notice of claim has been delivered to the Minister or agent of the Crown responsible for the public work and there has not yet been a determination of the dispute made by a court, and 180 days have not yet passed since the notice of claim was delivered.
