About Us
Alberta Dispute Adjudication for Construction Contracts (“ADACC”) is a Nominating Authority under the Prompt Payment and Construction Lien Act. As a Nominating Authority, ADACC is responsible for administering construction-related adjudications and for developing and providing initial training and continuing education for Adjudicators. ADACC derives its powers from thePrompt Payment and Construction Lien Act and the Prompt Payment and Adjudication Regulation:

ADACC is responsible for certifying Adjudicators and for maintaining a publicly accessible list of Adjudicators, including their qualifications (s. 33.2(2) of the Prompt Payment and Construction Lien Act). Only Adjudicators listed in the ADACC Adjudicator Registry will be appointed by ADACC to conduct adjudications and make determinations under the Prompt Payment and Construction Lien Act.
ADACC’s Duties and Powers
Section 33.2(2) of the Prompt Payment and Construction Lien Act sets out ADACC’s powers, duties, and functions as follows:
(2) A Nominating Authority must perform the following duties:
(a) qualify persons who meet the prescribed requirements as adjudicators;
(b) appoint adjudicators for the purposes of this Part;
(c) arrange for the hearing by adjudicators of prescribed matters for which that Nominating Authority is responsible;
(d) develop and oversee programs for the training of persons as adjudicators;
(e) establish and maintain a publicly available registry of adjudicators;
(f) perform any other duties as may be prescribed for the purposes of this Part.
Section 14.2 of the Public Works Act sets out ADACC’s powers, duties, and functions as follows:
A Nominating Authority must perform the following duties:
(a) qualify and appoint adjudicators;
(b) develop and oversee programs for the training of adjudicators;
(c) establish and maintain a publicly available registry of adjudicators;
(d) provide the Crown with timely notice of the commencement and completion of all adjudications, including copies of the referral to the Nominating Authority, the relevant notice of claim and the written determination of the dispute by the adjudicator;
(e) perform any other duties set out in the regulations.
